Hong Kong Tenancy Guarantors

Check a tenancy guarantee’s obligations, limits, duration, notices and renewal terms before signing. A guarantor and a witness have different roles.

Quick answer

A guarantor, tenant and witness have different roles. Read which agreement and obligations the guarantee covers, its limits and duration, and what happens on renewal or variation. Do not assume liability ends at one month’s rent or automatically continues unchanged.

Read the commitment

  • Identify the landlord, tenant, premises and agreement referred to.
  • Check which rent, costs, losses or other obligations are covered.
  • Look for a financial limit, end date and release provisions.
  • Read claim, notice, service, renewal and variation clauses before signing.

Different signing capacities

Different signing capacities
RoleCheck
Company signatoryAuthority to sign the tenancy for the company.
Personal guarantorA separate commitment defined by the guarantee.
WitnessThe witnessing role must not be confused with a guarantee.

Review renewal and changes

Compare the old guarantee with the new tenancy and changed terms. Identify what has been agreed and what still requires confirmation. Do not interpret silence as consent or assume every renewal automatically releases the guarantor.

Keep a complete copy

Keep the signed guarantee and all referenced attachments. CLIC explains personal and bank guarantees in its premises guidance; the actual residential commitment still depends on the documents and circumstances. Obtain independent advice about unclear terms and do not publicly circulate the guarantor’s identity or financial documents.

Hypothetical example

Rent changes on renewal. Do not assume the original guarantor automatically covers the new arrangement; check the guarantee and any required written confirmation.

Frequently asked questions

Is a guarantor just a reference or witness?

No. Check whether the document asks for witnessing or a substantive promise to meet obligations.

Are a bank guarantee and a family member’s guarantee interchangeable?

No. The issuer, wording, conditions and claim process can differ.
