Hong Kong tenancy guide
Hong Kong Pre-Tenancy Checks
Check the parties, authority, tenancy terms and records before signing in Hong Kong. Understand name matches, privacy and the limits of tenant screening.
Quick answer
Check identity and signing authority, agree the tenancy and payment terms, then review relevant sources. A name match is a lead to verify; neither a clean lookup nor an income document guarantees payment.
Prepare the signing documents
Identify the actual landlord, tenant and any representative. For a company, distinguish its authorised signatory from a director signing a separate personal guarantee. Compare the property and party details across the agreement and supporting documents.
Check the information fairly
- Explain why each document is needed and collect only relevant information.
- Compare original spelling, document dates and the stated employer or income period.
- Ask about discrepancies before drawing conclusions; keep the response with the relevant document.
- Restrict access to identity and financial documents and retain them only for an appropriate purpose and period.
Three checks with different purposes
| Check | What it does not establish |
|---|---|
| Land records | Do not by themselves prove an agent has authority to sign. |
| Income evidence | Does not guarantee future payment. |
| Public-record match | Does not confirm identity or amount to a credit rating. |
Before paying from overseas
Confirm the recipient and authority through a reliable channel. A person holding keys or sending a document screenshot is not sufficient proof of ownership. Keep the agreed inventory, handover arrangements and payment acknowledgements with the signed agreement.
Hypothetical example
If an agent signs for an owner, ask for the relevant authority. A matching name in a record does not establish that authority.
Frequently asked questions
Is tenant screening a credit score?
No. Identify the source, date and limitations of each result; WeCredit does not issue a credit rating.
Should every tenant provide an ID copy?
Do not treat this as an automatic requirement. Consider the purpose and necessity and follow the PCPD guidance linked below.
What if income and employment documents conflict?
List the conflicting fields, such as name spelling, employer, document date or salary period, and ask for an explanation and relevant supporting information, such as a relevant payslip or employment letter. Verify the contact channel and authority before approaching a source, and retain the reply. A discrepancy is not proof of forgery; avoid collecting unrelated bank transactions or third-party information.
What should I check when an agent or company representative signs?
Compare the named contracting party, the signatory and the scope of written authority. For a company tenant, check company identification and the basis on which the representative may sign. An agent’s authority to sign, collect money and act otherwise should be checked separately; a business card, keys or matching search result does not establish all of these powers.
How long should tenant information be retained?
Set a purpose, access controls and a deletion or review point, then assess which information remains necessary for the tenancy, any dispute and applicable requirements. Do not keep every applicant’s ID copy indefinitely or apply an online rule of thumb to every case. Public disclosure requires a separate assessment.
