Lands Tribunal Repossession
Prepare documents for a Hong Kong possession application, service and enforcement. Distinguish rent recovery, a possession order and actual repossession.
Quick answer
Check the grounds, parties and premises before following the Judiciary’s current application instructions. Filing, obtaining a possession order and enforcing it are different stages. A money demand does not itself authorise physical repossession.
Prepare the underlying file
- Identify the parties, property and basis for termination or possession.
- Keep the agreement, relevant notifications, stamping and rent reconciliation.
- Organise notices, responses and service evidence in date order.
- Use the official current forms and check the procedure and fees for the actual application.
Application stages
| Stage | Record to retain |
|---|---|
| Application | Filed documents, reference and requirements for the next step. |
| Service and response | The documents served, method, date and any reply. |
| Order | The actual order and its terms. |
| Enforcement | The applicable enforcement instructions and records. |
Service matters
Do not assume a letter or chat message satisfies every service requirement. Read the official instructions for the document and stage involved. An overseas landlord should separately confirm any representative’s authority and who will receive notices.
Follow the enforcement process
An order is not a general permission to use force or remove property personally. Follow its terms and the applicable enforcement procedure. Keep possession questions separate from any remaining money or deposit dispute.
Hypothetical example
An application has been lodged but no possession order obtained. A filing receipt does not authorise changing the locks.
Frequently asked questions
Are a rent claim and a possession claim identical?
No. Distinguish the money sought from the right to possession and check the appropriate procedure.
Can a Small Claims Tribunal money claim recover the flat?
Do not treat a money-claim process as a substitute for a possession procedure.
Can a WhatsApp message replace service of possession papers?
Do not apply a tenancy’s messaging clause to court papers. Follow Judiciary guidance and any specific order for the sealed documents, recipient, deadlines, method and proof of service. If service fails, check the procedure for alternative directions and record what actually occurred rather than declaring service complete.
