Ending a Fixed-Term Tenancy
Check Hong Kong fixed terms, break clauses, notice dates and mutual surrender before moving out. A forfeited deposit is not automatically a liability limit.
Quick answer
Read the actual term and termination provisions. Moving out, returning keys or offering the deposit does not automatically release every obligation. If no applicable break right exists, seek a clearly documented agreement to end the tenancy.
Different contractual arrangements
| Arrangement | Question to check |
|---|---|
| Fixed term | When does it end, and is early termination permitted? |
| Break clause | Who may exercise it, when and by what notice? |
| Option to renew | What conditions allow a further tenancy? |
| Mutual surrender | What have both parties actually agreed to release or settle? |
Check notice and termination dates
A clause allowing notice only after twelve months can operate differently from one requiring a termination date no earlier than twelve months. Read the exact wording and any conditions. This is a document-reading illustration, not a ruling on a particular agreement.
Record a proposed early exit
- Identify the agreement and proposed effective date.
- Distinguish agreed terms from proposals still awaiting consent.
- Address possession, keys, rent, deposit and remaining obligations.
- Keep the complete replies and obtain advice about disputed terms.
Replacement tenants and keys
Introducing a replacement tenant is not itself a release. Check subletting, assignment, consent and the agreed legal arrangement. Acceptance of keys should not alone be described as a settlement of every payment or damage issue.
Hypothetical example
A tenant plans to leave two months early without a compliant notice. Check the agreement or negotiate a written surrender before assuming the tenancy obligations end.
Frequently asked questions
Can I leave by forfeiting the deposit?
Do not assume that the deposit caps liability. Check the agreement and any express settlement.
Are a break clause and renewal option the same?
No. One concerns early termination; the other concerns a further tenancy.
Does a replacement tenant or returning keys end the tenancy?
Do not assume either act ends the original obligations. Confirm whether the landlord agrees to a surrender, subletting or a separate new tenancy, and record the effective date, remaining liabilities and settlement. Accepting keys, arranging viewings and discussing a replacement may not express the same agreement.
