Recovering a Rental Deposit

Organise a Hong Kong rental deposit dispute with itemised deductions, move-in and handover evidence, receipts and a clear settlement request.

Quick answer

Check the agreement, ask for itemised deductions and compare move-in with move-out evidence. Separate rent, damage, cleaning and other charges. If discussion does not resolve the dispute, check the appropriate advice or claims route.

Build a deduction schedule

  • Copy the deposit and return provisions from the actual agreement.
  • List each proposed deduction and whether it is agreed or disputed.
  • Match the item to condition photographs, inventory and inspection records.
  • Ask for the basis of the amount, distinguishing a quotation, invoice and proof of payment.

Evidence to compare

Evidence to compare
IssueUseful records
Wear or damageEquipment age, initial condition and before/after photographs.
CleaningAgreed condition, handover record and the actual work claimed.
Unpaid chargesThe agreement, billing period and payment acknowledgements.

Request an explanation and settlement

Identify the property, agreement, amount paid and handover date. Ask which deductions are claimed, the supporting documents and what amount can be agreed now. Keep the complete response. Do not impose a universal deposit-return deadline without checking the applicable terms and tenancy requirements.

If a claim is needed

Read the Judiciary’s Small Claims Tribunal guidance on scope and procedure and the linked CLIC explanation. A money claim is different from a claim for possession. Choose the route using the actual amount and nature of the dispute, rather than assuming every rental dispute belongs in the same tribunal.

Hypothetical example

A landlord requests a cleaning deduction. Compare the relevant term, incoming and outgoing photographs, and the supporting charge rather than debating an unexplained total.

Frequently asked questions

Can the deposit automatically pay the final rent?

Do not assume so. Check the agreement and any confirmed arrangement before withholding rent.

Does one move-in photograph guarantee recovery?

No. Match it to the property, equipment, date, handover and the reason for the deduction.

How should wear, cleaning and repair deductions be compared?

Compare the relevant obligation, incoming and outgoing condition, prior condition, period of use, cause and evidence of the amount. Distinguish ordinary use, pre-existing damage, cleaning and new damage; a request for replacement does not itself establish liability for a whole new item. Match photographs by location and date, and separate quotations from paid invoices.

What if the deposit receipt is lost?

Keep the deposit clause, transfer confirmation and related correspondence, matching date, amount, recipient and purpose. Ask the recipient for a traceable replacement or written acknowledgement. Do not create a document purporting to be their original receipt; identify unresolved discrepancies in the evidence file.
