Hong Kong tenancy guide
Hong Kong Subletting Checks
Check a head tenant’s letting authority, original agreement, permitted area and consent before entering a Hong Kong subtenancy.
Quick answer
Review the original agreement, the proposed letting scope and written authority. Holding keys, receiving rent or saying the owner agreed does not establish the full right to sublet.
Identify the parties
Distinguish the registered owner, original tenant, proposed subtenant and any agent. Ask who will sign, collect money, arrange access and return the deposit, and keep the basis of each person’s authority.
If the original tenancy changes
Ask how expiry, termination or another change to the original agreement affects the proposed arrangement. Do not assume the subtenancy can continue on the same terms regardless of the head tenancy. Resolve important uncertainties before paying.
A hypothetical authority mismatch
If a proposed landlord produces a tenancy in another person’s name but no relevant authority, ask for clarification. That discrepancy is a reason to investigate, not a finding that fraud has occurred.
Compare the two checks
| Item | What to check |
|---|---|
| Head tenancy | Check subletting restrictions and consent. |
| Subtenancy | Check scope, payment and handover responsibilities. |
Hypothetical example
A head tenant offers keys but no relevant agreement or authority documents. Clarify their letting authority and the proposed term before committing.
Frequently asked questions
Does consent to sublet release the original tenant?
Not automatically. Read whether the document permits subletting, changes a party or expressly releases obligations.
Can the head tenant ignore a no-subletting clause?
Check the actual clause and any valid permission rather than relying on an oral assurance.
